Terms and Conditions
1. ABOUT THESE TERMS & CONDITIONS
1.1 These terms and conditions of business are between A2H Solutions Ltd (“The-hospitalitynetwork”) and the Client indicated on the final page (“Client”).
1.2 All use of the Services is subject to this Agreement, and this Agreement excludes and replaces all other agreements or terms relating to the Services.
1.3 This Agreement comes into force when signed by both parties.
1.4 “Agreement” means this agreement including the order form setting out the Client’s requirements and details of fees payable to The-hospitalitynetwork by the Client.
“Candidate” means an individual any of whose details are obtained by the Client from the The-hospitalitynetwork service.
“Client” shall include any subsidiary, associated or holding company (or their subsidiaries)
“Services” means the services provided by The-hospitalitynetwork under this Agreement. “Site” means the website(s) operated by A2H Solutions Ltd for the purpose of referring relevant traffic to the client’s own site or the clients’ employees email accounts.
1.5 No variation can be made to these terms without the written consent of A2H Solutions Ltd.
2. SUMMARY OF SERVICES
The-hospitalitynetwork provides a platform where job listings from our customers that can be shared with our trusted partners to generate applications from interested candidates. By using our services, you agree to the following terms and conditions regarding the sharing of jobs with our partners:
2.1 Under this Agreement, The-hospitalitynetwork provides the Client with the services detailed in the booking form. These services will be constructed and provided by The-hospitalitynetwork using images and wording provided by the client. The agreement will continue in force for the period specified.
2.2 Purpose of Job Sharing: The primary purpose of sharing jobs with our partners is to expand the reach of job opportunities and attract a larger pool of potential candidates. This enables our customers to receive a higher number of applications for their vacancies.
2.3 Partner Terms and Conditions: When a job is shared with our partners, the subsequent collection and handling of candidate data will be governed by their respective terms and conditions and privacy policies. We encourage you to review these documents to understand how your personal data will be managed by our partners.
2.4 Candidate Consent: Candidates who apply for jobs through our partners' platforms or channels are subject to the terms and conditions and privacy policies of those partners. The-hospitalitynetwork is not responsible for the actions, policies, or practices of our partners in relation to the collection, use, and protection of candidate data.
2.5 Data Protection: We take data protection seriously and will share jobs with partners who have agreed to comply with applicable data protection laws and uphold high standards of data security and privacy. However, we cannot guarantee the actions or compliance of our partners beyond our direct control.
2.6 Accountability: While we make reasonable efforts to select trustworthy partners, The-hospitalitynetwork shall not be held liable for any damages, losses, or disputes arising from the actions or services provided by our partners in relation to job application generation.
2.7 Opting Out: If you prefer that your job listings are not shared with our partners for application generation, please contact us directly to discuss your preferences. We will make reasonable efforts to accommodate your request, understanding that this may affect the reach and exposure of your job listings.
2.8 By continuing to use our services and agreeing to these terms and conditions, you acknowledge that the sharing of jobs with our partners for application generation involves the transfer of candidate data to those partners, subject to their terms and conditions and privacy policies. It is your responsibility to review and understand the terms and conditions and privacy policies of our partners before engaging with their platforms or channels.
3. PAYMENT OF FEE
3.1 The Client will pay the fee in accordance with the requirements of the booking form.
3.2 Late Payment: should the Client fail to make any payment when due, The-hospitalitynetwork reserves the right to suspend Services to the Client. The Client will be responsible for any legal costs incurred in recovering the amounts due, and A2H Solutions Ltd may also charge interest on the full amount due from the due date until the date that full payment is received (before and after judgment) at the base rate of the Bank of England plus 4%, calculated daily.
3.3 For fixed term contracts, the fees set out in the booking form may be varied by A2H Solutions Ltd on any renewal of the Agreement.
3.4 For rolling contracts, it may become necessary to increase prices, for example, in line with the rate of inflation. In this instance, A2H Solutions Ltd will provide notice in advance, explaining why the change is required.
3.5 For fixed-term contracts (i.e. 3, 6 or 12 months), any discounts provided by The-hospitalitynetwork are redeemable by A2H Solutions Ltd if the Client terminates the arrangement before the agreed end date of the service schedule.
3.6 For rolling contracts, any discounts provided by The-hospitalitynetwork will not be redeemed by A2H Solutions Ltd upon termination.
4. CLIENT’S OBLIGATIONS
4.1 The Client agrees that for so long as it is party to this Agreement:

4.1.1 The Client will provide approved logos, pictures and branding to be used on the site. The Client shall ensure that all information that it provides to The.hospitalitynetwork is accurate, does not contain any misleading items or misrepresentations and does not breach any applicable law.
4.1.2 The Client shall not use any information regarding Candidates for any purpose other than the recruitment of staff for its own internal or group business.
4.1.3 The Client shall not attempt to access data or any parts of The.hospitalitynetwork system which it is not authorised to access.
5. CONTRACT TERMINATION
5.1 For fixed-term contracts (i.e. 3, 6 or 12 months), termination of the contract before the agreed end date, will require notice in writing (by email) at least 120 days prior to the date that the next invoice is due to be issued. All contracts to be issued for a period of 12 months unless otherwise stated.
5.1.1 On receipt of the Client’s written notice to terminate, the contract will be scheduled to expire on the date that the next invoice is due to be issued.
5.1.2 The Client will need to receive written acknowledgement from A2H Solutions that the termination notice has been received; if this acknowledgement is not received by the Client, it means that the written notice of termination has not been received by A2H Solutions Ltd and the contract has not been cancelled.
5.1.3 A2H Solutions Ltd are not able to reimburse any payment that has already been made (either in full or in part).
5.2 For rolling contracts, termination of the contract will require notice in writing (by email) at least 120 days prior to the next contract roll over date.
5.2.1 On receipt of the Client’s written notice to terminate, the contract will be scheduled to expire on the next contract roll over date, assuming this is at least 120 days in the future. If notice is given less than 120 days before the next contract roll over date, the contract will be scheduled to expire on the contract roll over date following the next contract roll over date.
5.2.2 The Client will need to receive written acknowledgement from A2H Solutions Ltd that the termination notice has been received; if this acknowledgement is not received by the Client, it means that the written notice of termination has not been received by A2H Solutions Ltd and the contract has not been cancelled.
5.2.3 A2H Solutions Ltd are not able to reimburse any payment that has already been made (either in full or in part).
6. CONTRACT EXPIRY
6.1 When a contract expires, all live jobs will be suspended and all job and CV credits will be set to zero.
6.2 Unused job or CV credits will not be available to use once the account has expired.
6.3 An account can expire at any time on the scheduled expiry date. The expiry time is not related to the time of day at which the contract initially commenced.
6.3.1 A contract will normally expire between 12pm and 5pm on the scheduled expiry date. However, this is not guaranteed and is at the discretion of A2H Solutions Ltd.
7. JOB POSTING
7.1 A2H Solutions Ltd operates a programmatic network system, rather than a job quota system.
7.1.1 The system allows the Client to post as many jobs as they like while a contract is live, with any number of jobs live at any one time.

8. A2H Solutions Ltd RIGHTS
8.1 The-hospitalitynetwork may suspend or block the Client’s access to the Services at any time if the Client is in material breach of any of the terms of this Agreement.
8.2 The-hospitalitynetwork will be developing its website and service further, so reserve the right:
8.2.1 To make changes to the Site and Services;
8.2.2 To render the Services unavailable for periods where this is necessary for development or maintenance.
8.3 The-hospitalitynetwork may use the logos and branding provided by the client anywhere on the site and within marketing material
8.4 The-hospitalitynetwork reserves the right to cancel any contract without notice.
9. REFUNDS
9.1 Refunds are offered in the following circumstances:
9.1.1 Where a refund is requested prior to an account being activated.
9.1.2 Where The-hospitalitynetwork is unable to publish the Client’s advert because it does not comply with these terms and conditions.
9.1.3 If our website is down for a period in excess of 120 hours.
9.1.4 Refunds may sometimes be offered at the discretion of the management.

9.2 Once an account has been activated and services have been used (i.e. jobs have been posted and profile added) A2H Solutions Ltd is unable to offer any refunds, whether in part or in full unless otherwise agreed by management.
9.3 The-hospitalitynetwork is not able to offer refunds in the following circumstances:
9.3.1 If a Client receives no job applications, or less applications than expected.
9.3.2 If a Client feels that the applications received are inappropriate for their needs.
9.3.3 If a Client is unable to make contact (either by phone or email) with Candidates that have been sourced through The-hospitalitynetwork.
9.3.4 If a Client is unable to make placements or arrange interviews with Candidates that have been sourced through The-hospitalitynetwork.
10. CONFIDENTIALITY
10.1 The parties agree that they will only use the other’s confidential information for the performance of this agreement, and will not disclose it to other parties other than as necessary for the performance of this Agreement or as required by law.
11. LIABILITY
11.1 In view of the nature of the Services, the Client must satisfy itself as to the suitability of any Candidate. The Client is responsible for the taking up of references and for establishing the Candidate’s qualifications, capabilities, honesty, medical history, availability and suitability to meet the Client’s requirements. The-hospitalitynetwork does not verify or warrant the accuracy or reliability of any information posted or received via the Services, and reliance on the information is at users’ own risk.
11.2 The-hospitalitynetwork is acting not as an employment agency or employment business, but as a conduit for information relating to Candidates between employers and potential Candidates. The-hospitalitynetwork is not in the business of finding employment for workers or workers for employers. Accordingly, the Employment Agencies Act 1973 and corresponding regulation does not apply.
11.3 The-hospitalitynetwork gives no warranty or representation, expressed or implied, in respect of any Candidate introduced and accept no liability for any failure of a Candidate to perform or comply with their terms of employment or engagement, or for any loss, expense, damage or delay, however caused, arising from the introduction of the Candidate to the Client’s employment.
11.4 The-hospitalitynetwork will endeavour to keep the Services working as often as possible, but will not be responsible for any time for which it is unavailable, whether due to telecommunications or internet failures or otherwise. All users are responsible for taking appropriate measures against the risks associated with using the internet, including viruses and other harmful mechanisms, and The-hospitalitynetwork will not be liable to the Client for any loss, damage or liability caused by any such item.
11.5 Each party’s entire liability to the other party, whether in contract, tort (including negligence) or otherwise, shall be limited to the fees paid by the Client to The-hospitality Network for the service period during which such liability arose.
11.6 In no event will The-hospitalitynetwork be liable to the Client for any indirect, consequential or special loss or damage, including lost profits, sales, business, data, goodwill, savings or otherwise, however caused (including by negligence).
11.7 Nothing in this Agreement limits The-hospitalitynetwork liability for death or personal injury caused by its negligence, or for fraudulent misrepresentation.
11.8 If any of the preceding sub-Clauses is found invalid or unenforceable, the remaining sub-clauses remain in full force and effect.
12. GENERAL
12.1 All copyright, trademarks, patents, database rights and other intellectual property rights in the Site, Services and underlying functions are the property of A2H Solutions Ltd or its licensors, and the Client must not copy, alter or otherwise infringe any such rights.
12.2 This Agreement is the entire agreement between The-hospitalitynetwork and the Client, and supersedes all previous agreements and statements relating to its subject matter.
12.3 This Agreement is governed by English law, and the Client submits to the exclusive jurisdiction of the English Courts.
